Backyard Aces LLC – Terms of Service

Welcome to Backyard Aces LLC (“Backyard Aces,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern the booking, rental, and use of our mobile golf simulator services and related equipment (the “Services”).

By booking an event, signing any agreement or waiver, or using our Services, you agree to be bound by these Terms.

1. Service Overview

Backyard Aces provides mobile golf simulator rentals for private parties, corporate events, fundraisers, school functions, and similar events. Services include delivery, setup, operation support, and breakdown of simulator equipment.

Our Services are offered within the Commonwealth of Massachusetts and surrounding areas, subject to availability.

2. Booking, Payment, and Contracts

2.1 Booking Confirmation

A booking is not confirmed until:

  • A completed booking request is received

  • A required deposit or full payment is made

  • All required contracts and waivers are electronically signed

Backyard Aces reserves the right to decline or cancel bookings at its discretion prior to confirmation.

2.2 Payment Terms

  • A non-refundable deposit of 50% of the total rental fee is required to secure your reservation unless otherwise stated in writing.

  • The remaining balance is due no later than the day of the event, prior to setup.

  • For bookings made within a short time frame before the event, full payment may be required upfront.

All payments are processed securely through Square.

2.3 Cancellation Policy

  • Cancellations made 7 days or more before the event may be eligible for a refund of the full amount including the deposit, unless otherwise stated in your agreement.

  • Within 7 days of the event, the initial 50% deposit becomes non-refundable.

  • Backyard Aces is not responsible for cancellations due to weather, venue restrictions, or circumstances beyond our control unless otherwise specified in writing.

3. Customer Responsibilities

3.1 Space and Site Requirements

The customer is responsible for providing a suitable setup area, which generally requires:

  • Approximately 15 ft (D) x 14 ft (w) x 11 ft (H) of clear, level space

  • Grass, pavement, or concrete surfaces are acceptable

  • Access to a standard power outlet, unless otherwise arranged

Failure to provide an adequate space may result in delayed setup or cancellation without refund.

3.2 Safety and Supervision

The customer agrees to:

  • Maintain a safe environment for all participants and spectators

  • Ensure adult supervision for any participant under the age of 18

  • Enforce all safety rules provided by Backyard Aces staff

Backyard Aces reserves the right to suspend or terminate simulator use if unsafe conditions exist.

3.3 Equipment Care, Loss, and Damage

The customer is responsible for all equipment during the rental period. Any damage, loss, or theft caused by misuse, negligence, or failure to follow instructions may result in additional charges for repair or replacement.

4. Backyard Aces Responsibilities

4.1 Setup and Breakdown

Our team will handle delivery, setup, and breakdown of the simulator equipment. Typical setup and breakdown times may vary depending on site conditions and event logistics.

4.2 On-Site Support

When included in the booking, Backyard Aces staff will provide operational and technical support during the event to ensure proper use of the simulator.

4.3 Equipment Condition

We maintain our equipment in good working order. If technical issues arise, we will make reasonable efforts to resolve them; however, uninterrupted operation is not guaranteed.

5. Assumption of Risk and Limitation of Liability

Use of the golf simulator involves physical activity and inherent risks. To the fullest extent permitted by Massachusetts law:

  • The customer and all participants assume all risks associated with use of the simulator and related equipment

  • Backyard Aces LLC shall not be liable for injuries, damages, losses, or claims arising from use or misuse of the Services or equipment

  • Backyard Aces is not responsible for damage to property, landscaping, or personal items at the event location

Participants must comply with all posted and verbal safety instructions at all times.

6. Media Release

Unless a customer or participant opts out in writing prior to the event, Backyard Aces may take photographs or videos during events for marketing, promotional, and social media purposes. No compensation will be provided for such use.

7. Intellectual Property

All content, branding, logos, images, text, and software used or provided by Backyard Aces are protected by applicable intellectual property laws. Content may not be copied, reproduced, or used without prior written consent.

8. Privacy

Your use of the Services is subject to our Privacy Policy, which explains how we collect and use personal information. The Privacy Policy is incorporated into these Terms by reference.

9. Governing Law and Venue

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to conflict of law principles. Any disputes shall be brought exclusively in the state or federal courts located within Massachusetts.

10. Changes to Terms of Service

Backyard Aces reserves the right to update or modify these Terms at any time. Updates will be posted on our website, and continued use of our Services constitutes acceptance of the revised Terms.
